DMCA Policy

Bermuda Tech Creations Ltd. ("we", "us", or "our") is committed to respecting intellectual property rights and expects our users to do the same. In line with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we promptly address claims regarding copyright infringement that are reported to our designated Copyright Agent identified in the example notice below.

If you are the copyright holder, someone authorized to act on their behalf, or someone with exclusive rights under copyright law, please report any alleged copyright infringements occurring on or via our website (the "Site") by filling out the provided DMCA Notice of Alleged Infringement and submitting it to our designated Copyright Agent. Upon receiving the Notice as outlined below, we will take appropriate action in our sole discretion, which may include the removal of the infringing content from the Site.

• 1. Clearly identify the copyrighted work that you believe has been infringed, or if multiple works are involved, provide a representative list of those works.
• 2. Specify the material or link you believe is infringing (or associated with infringing activity) and should be disabled, including, at a minimum, the URL of the content on the Site or the exact location of the material.
• 3. Provide your company affiliation (if relevant), mailing address, phone number, and, if available, email address.
• 4. Include both of the following statements in your Notice:
• * "I hereby affirm that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (for instance, as a fair use)."
• * "I affirm that the information in this Notice is accurate and, under penalty of perjury, that I am either the copyright owner or authorized to act on behalf of the copyright owner regarding the material allegedly infringed."
• 5. Provide your full legal name along with your electronic or physical signature.

Note that under Section 512(f) of the DMCA, anyone who knowingly misrepresents that material or activity is infringing may face legal liability.

If you believe that your content, which has been removed or access to which has been disabled, is not infringing, or if you have permission from the copyright owner, the copyright owner's agent, or under law, to use such content, you may submit a counter-notice to our Designated Copyright Agent with the following information:

• 1. Your physical or electronic signature;
• 2. Identification of the content that was removed or disabled and the location where it appeared prior to removal or disabling;
• 3. A statement asserting your good faith belief that the content was removed or disabled due to a mistake or misidentification of the material;
• 4. Your name, address, phone number, and email address, along with a statement confirming your consent to the jurisdiction of the federal court in Seychelles and your agreement to accept service of process from the individual who notified us of the alleged infringement.

Upon receipt of a counter-notice, we may forward it to the original complainant, informing them that we might restore the removed content or cease to disable it within 10 business days. Unless the copyright owner files a lawsuit seeking a court order against the content provider or user within that timeframe, we may, at our discretion, replace the removed content or restore access to it within 10 to 14 business days.

In compliance with the DMCA and relevant laws, we maintain a policy of terminating users who are identified as repeat infringers, where appropriate and at our discretion. We also reserve the right to limit access to the Site and/or terminate accounts of users who infringe on the intellectual property rights of others, regardless of whether such infringement is repeated.
